A Nigerian player signed for an American club side in the USL, and then featured for a Norwegian club. Americans are going to refer it to FIFA becuase they say he's under contract to the American club.

Seems like he had a contract for a month-long trial not a contract to play for NYRB. He was unable to obtain a visa to attend the trial and so he didn't have a trial.
If he had failed the trials I'm sure he'd be free to sign elsewhere... his agents can argue that not showing up for a trial is somewhat equivalent to failing a trial.

... and I believe such argument by his agent(s) if presented makes a lot of sense.
