So even if the player had lashed out and the player left his foot hanging and made a small contact, that would be simulation!
There really is no ambiguity. The only issue has been that referees and committees have been so poor at dealing with this issue that players have now begun to confuse the issue.
There are so many facets of this issue and some will think that theirs is innocent. For example some players like Victor Moses 'expect contact' to be made, that is a form of diving. You do not anticipate contact! Because what will happen is even before contact is made, they are already thrusting themselves. And even if they weren't, by the time contact is made, they are already prepared to exaggerate its effect!
Bad defending or messy defending does not make a case for diving, unless significant contact is present!

There was contact with the left leg and it looks like that at first glance @ 0:12 but a different angle for the replay makes it look like the contact was phantom. How bad is the lash out? u can't be very certain but the intent is enough.

What is diving? Is it actually exaggerating the contact so as to con the ref?
From the video, it seems the guy on the floor either tried to trip him or kick at the ball. But was there contact and was the contact enough to make the player fall like that?
Looking at the video from 0:31, it seems the player evaded the tackle, tried to kick the ball then suddenly decide to do a slide and fall down. That is clear cheating. There was daylight between the time when the player attempted the tackle and the time the cheating player decide to hit the deck.
We just talk about contact now as if every contact is a foul.

I even think a free kick should have been awarded the other WA because the diving player actually shoved his marker in the back causing him to fall over
