Amaju Pinnick has reacted to his sack as president of the Nigeria Football Federation (NFF), describing it as “null and void”.

On Monday morning, the Minister for Youths and Spo‎rts Development, Barr. Solomon Dalung, ordered the current NFF board to vacate their office, in respect to a ruling by the apex court in Nigeria, the Supreme Court.

Dalung also asked Chris Giwa, who was voted as President of the NFF through a congress that wasn’t recognized by FIFA, to take over the running of the Glass House.

However, Daily Post reports that Festus Keyamo SAN, counsel to Pinnick says the ruling cannot stand. A statement from Keyamo’s chambers on the ruling reads:

“We are solicitors to Mr. Amaju Pinnick and the present Board of the NFF which he heads. We issue this statement on the instruction and directive of our clients which reflects their official position on the matter.

“The attention of our clients has been drawn to a statement purportedly issued at the behest of the Minister of Sports, Mr. Solomon Dalung, directing the NFF to comply with certain court orders effecting a change of leadership in the NFF.

“Our clients wish to alert the general public and the authorities in Nigeria that the so-called directive by the Minister of Sports is null, void and of no effect for the following reasons.

“(1) Whilst our clients respect the sanctity of court orders, unfortunately the said court orders are not binding on FIFA, the World Football Governing Body. The NFF is an affiliate of FIFA. It should be noted that FIFA has consistently maintained that this same matter has been taken to the highest Court of Sports Arbitration in Switzerland by these same individuals and they have lost. FIFA is only bound by the decision of the Court of Arbitration for Sports AND DOES NOT ENTERTAIN OR TOLERATE decisions by local courts in footballing nations worldwide. Hence, FIFA has since upheld the decision of the Court of Arbitration on this matter and recognized the NFF Board led by Amaju Pinnick. Nigeria has a duty to comply with that decision. In addition, for the indiscretion of those individuals like Chris Giwa to approach the local courts, FIFA has since imposed a worldwide ban on them from all footballing activities.

The end result is that Chris Giwa and his so-called Board members do not have any locus standi with regards to footballing matters and the Federal Government CANNOT have any dealing with them on any footballing matter. The obvious implication of all these is that if any attempt is made to recognize Chris Giwa and derecognize Amaju Pinnick and his Board, FIFA WILL DEFINITELY IMPOSE A LENGTHY BAN ON NIGERIA from all football competitions locally and internationally and that will spell doom for Nigerian Football.

“The immediate casualties of this ban would be (a) The Falconets who have qualified and are scheduled to participate in the Under-20 Female World Cup in July, 2018 (b) The final phases of the AFCON Qualifiers for the Super Eagles scheduled for August/September, 2018 (c) The Super Falcons defending their title in December in Ghana (d) No Nigerian Club side would be allowed to participate in the Continental Championships and (e) the future of all Nigerian players based in Nigeria would be in jeopardy as no Nigerian player would be allowed to be sold or transferred to any club anywhere in the world.

“Please, find attached the latest letter from FIFA to Chris Giwa, through his lawyers confirming the position of FIFA on this matter.

“(2) In view of these facts above, our clients have taken steps to vacate the orders given by the Federal High Court in Jos. It should be noted that the said orders were given ex-parte (one-sided), as no other person was served with court processes. It should also be noted that the orders were given against Amaju Pinnick and his Board members (who are not parties to the case and were never served) and in favour of Chris Giwa (who is also not a party to the case). Besides, these orders are to last for only fourteen (14) days as provided by the Rules of Court. Our clients state these facts as they are in order to inform the public of the nature of the orders given without meaning to denigrate the authority of the court.

(3) The Attorney-General of the Federation, Abubakar Malami, SAN, a few weeks ago, having studied the Supreme Court judgment has already advised (by a letter dated 13th June, 2018) that the matter is subjudice, and that Government cannot intervene at this point. He advised all parties to await the FINAL DETERMINATION of the case. However, in a desperate attempt to assume office at all cost, Chris Giwa sneaked back to court to obtain these ex-parte (one-sided) orders prompting the office of the Attorney-General to issue yet another advice again dated June 26, 2018, advising compliance to the court order.

“(4) Finally, our clients also urge restraint and caution because the substantive matter is pending in court and has not been fully determined. Our clients have also taken steps to set aside these orders. Therefore, it is important that the Government awaits the full and final determination of the entire matter. It may be the contention of Chris Giwa and his so-called Board that the Rule of Law must be obeyed which means an immediate enforcement of the one-sided (ex-parte) orders. However, Nigeria is also bound to abide, recognize and enforce the decisions of the Courts of Arbitration for Sports which have since dismissed the case of Chris Giwa and his so-called Board, and affirmed Amaju Pinnick and his Board as the authentic leadership of the NFF.

“Our clients are therefore VERY SHOCKED that despite these glaring question marks, the Minister of Sports refused to advise Government correctly as to the position of FIFA on this matter and the existence of an Award against Chris Giwa and his so-called Board by the Court of Arbitration for Sports. The Press Release by the Minister of Sports would definitely cripple football in Nigeria and make Nigeria a pariah State regarding football. Our clients do not, by this letter, want to give credence or promote so many insinuations, peddled about, as motivating the actions of the Minister of Sports. Our clients only urge the President and Commander-in-Chief, President Muhammadu Buhari to urgently reverse the position of the Minister of Sports and save Nigerian Football from collapse.

“As a result of the CLEAR AND UNEQUIVOCAL position of FIFA on this issue, our clients urge the President to INSTRUCT the Minister of Sports to engage strong legal representation to challenge these court orders that were given without hearing from anyone or joining anyone on the other side (including the Minister of Sports).

“Whilst this is being done, our clients urge the President to direct all parties and law enforcement agencies to await a full determination of the case before doing anything in this regard as a result of the decision of the Court of Arbitration for Sports which is also enforceable in Nigeria.

“The final point to make is that our clients wish to draw the attention of everyone to the fact that the NFF is not an independent association. It is an affiliate of FIFA. By virtue of Article 59, Paragraphs 2 and 3 of FIFA Statutes, FIFA does not tolerate such actions taken by Giwa and his so-called Board to destroy Nigerian football.

“Therefore, by virtue of the responsible position Nigeria holds in the Comity of Nations, it would be advisable that the President directs everyone to toe the line of FIFA and respect the final decision of the Court of Arbitration for Sports on this matter, instead of giving vent to the ambition of ONE MAN (Chris Giwa) who wants to bring down the entire edifice of football on all our heads to achieve his selfish ambition.”

with every post world, there will always been one drama or another plaguing Nigerian football...I feared something of this sort would happen ahead of the NFF elections. If its true that Pnnick has stepped down as been circulated all over the media, then it doesn't look good for Rohr...needless to say we also face a possible FIFA ban.

PaJ, while I like Pinnick and I think he should stay, Green is seeking justice. It is alleged that Pinnick used the instrument of state to get his rivals arrested barring them from the election.

Yes, he is doing relatively well but if it were you that were on the receiving end of alleged injustice would you just let it go? Remember there were attempts to reconcile the two parties and Pinnick wasn't having it.

Are we talking about Chris Green or Chris Giwa? These are two different people. I believe you may be referring to Chris Giwa (correct me if I am wrong on this) and he has presented his case through the legitimate channels which were both FIFA and CAS and in both places he lost the case. Moreover, his insistence in going outside the FIFA-directed conflict-resolution processes (i.e. the courts) earned him an unprecedented ban that was affirmed at both CAF and FIFA levels. It is hard to see how he will be allowed to preside over Nigerian football. If the government insists on Giwa, then surely FIFA will ban Nigeria and legitimately so. One cannot force his way after he had been rejected at each appropriate spaces where football conflict is to be resolved. When the FIFA ban takes place (a certainty), I anticipate unprecedented pressure on the government for which Dalung's job may face scrutiny to be sure.

The larger question is why the AG should provide uninformed advise to the government. Nigeria is a FIFA member and had agreed to abide by FIFA statutes which include agreement to follow outlined conflict resolution processes. The AG should have informed the courts (If summoned) that the case should not have been heard in the courts since the parties have agreed (as members affiliated to FIFA) that disputes cannot be settled in courts but through FIFA's arbitration processes. So no matter Giwa's grievances (To be sure he has grievances), the correct processes should be followed.

Many thanks for this txj. Just out of interest do you not think it is absurd that after nearly 4 years after the said disputed election, a courtrules in Giwa's favour? Firstly if the tenure of the NFA chairman runs for 4 years, does it then mean Giwa would serve for a few weeks before re-election?

If that is indeed the case doesn't it then conflict with the democratic electoral process of the NFF? It also means that the court is imposing an ineligible candidate and obstructing an autonomous body.

Is there not a statute of limitations concerning the case and the elapsed period? How many times can a case be brought before a court and shouldn't the hearing be time bound?

Honestly, Nigeria law is a joke. It makes absolutely no sense, they'll be the laughing stock of civilised countries.

We might as well kiss Nations cup and the next World cup tata!

Foolish Pinnick .........he forgot that Supreme court judges are also football fans.
After getting served with cowardly heart attack football by Rohr, the foolish Pinnick said he will retain the coward........that was the last straw for the Judges.

Nigerian desk in FIFA headquarters will be expected to issue their usual threat of ban on the nation in view of the sack of the outgoing Amaju Pinnick illegal board of the FA which had occupied the seat against the orders of court.

It would be recalled that Justice Ambrose Allagoa of the Federal High Court had issued a motion exparte on the Aminu Maigari-led NFF not to hold the elective congress of the organisation that was billed for 30th September. Justice Ambrose Allagoa of the Federal High Court Jos ruled against the NFF elections in Warri of 30th September as well as the congress preceding it because they were against his orders. “I have set aside all the proceedings and decisions of the Warri Extra Ordinary meeting of the 20th September and the Elective Congress of 30th September which were direct contravention of the orders of this court as granted on the 19th September,” said Justice Allagoa.

They spurned the court and held the election and the court in its next sitting ordered that the entire process in Warri is “illegal, null, void and of no consequence in law. The NFF would not respond to the court at all until the defendants were asked to appear for contempt proceedings when suddenly they employed the services of a lawyer to swerve the committal to prison.

As usual, the Nigerian desk in FIFA issued a letter of seven months ban threat which the Goodluck Jonathan administration fretted and begged the plaintiff to withdraw the matter as part of the room for resolution. Once the presidential intervention was gotten, the plaintiffs were spurned. The defendants, having secured a conditional withdrawal notice returned to the court. They demanded for all previous orders of court to be revived in the re-listing of the matter.

Justice Haruna Musa Kurya relisted the earlier withdrawn case between Giwa and the NFF as well as upheld the nullification of the Pinnick-led board which were prayers of petitioners: Yahaya Adama and Obinna Ogba. According to him, Giwa will be temporarily in charge of the nation’s footballing body pending final verdict of the case. This is the second order of that court which the Supreme Court upheld. Upon getting the plaintiffs’ prayers answered, the defence counsel, Festus Keyamo, went to the Court of Appeal. Amaju Pinnick’s legal team won in the Court of Appeal which the Adama Yahaya and Obinna Ogba (as respondents/applicants) went to the Supreme Court decision sending both parties back to the Federal High Court in Jos for re-trial but sustaining the orders of the lower court.

Implications of the FHC orders:

Irrespective of the incidents leading to the decisions of the court, it is clear and evident that two issues are germane and very instructive:

After every FA elections, there are reconciliatory and mediatory efforts of building bridges of friendship with those who lose in the election. This was not done;

Rather, painful and intensely deep wounds were sculptured by the Pinnick team that did a winner-takes-all. After President Jonathan’s intervention leading to the conditional withdrawal, the other parties were spurned;

Two, the rules were skewed to force the club belonging to Ambassador Chris Giwa out of the league. This emotive barrage equal to the bombing of Nagasaki would NOT allow for any form of reconciliation. That is where we are today.

While the matter was before a court of law, five members of the Giwa group were selected and banned for five years! This deepened the fight. With the slight window of the page 25 second paragraph of the Supreme Court decision, why do anyone reasonable person think the Giwa folks would not also do the winner-takes-all even if FIFA’s Nigerian desk will ban the nation for life.

FIFA and court cases: If the age-old lies that FIFA matters does not go to court is anything to go by, why and how does the same FIFA obey and respond to Swiss laws? Was it not a Swiss court that did immediate past FIFA President, Joseph Sepp Blatter in?

Case number 1: On the 26th September 2015 Sepp Blatter’s tenure as FIFA president suffered a new blow after the Swiss Attorney General opened an investigation targeting him on “suspicion of criminal mismanagement.” A statement released by the office of the attorney general of Switzerland confirmed it was examining a contract signed by Blatter with the Caribbean Football Union and an alleged “disloyal payment” of 2 million Swiss francs (about $2 million US) to Michel Platini, the head of European football body UEFA.

Former senior FIFA official Jack Warner was indicted in a wide-ranging bribery scandal, while Platini entered the race to succeed Blatter as FIFA president in July. The statement was released after Blatter, who has been in charge of soccer’s world governing body since 1998, was interrogated by the Swiss attorney general’s representatives Friday following a meeting of the FIFA executive committee in Zurich. Question is, is Switzerland’s attorney general more superior to the Nigerian attorney general on matters that is Nigerian? Please spew the chaff in the mouth.

Case number 2: “Pursuant to that request for mutual legal assistance of 14th January, 2016 and in close coordination with the office of the attorney general of Switzerland, the French Financial Prosecution Office proceeded (equivalent of our own EFCC) to a search of the offices of the French Football Federation (FFF) in Paris with the latter’s consent. The office of the attorney general of Switzerland (OAG) was present during the search. Question is, FIFA did not remember to ban or threaten to suspend the French Football Federation or even Switzerland.

Case number 3: While still sleeping during a FIFA Congress, seven executives were hauled out of their beds in Zurich’s five-star Baur au Lac hotel and accused of the “World Cup of fraud”, the US Department of Justice through the FBI revealed that one baron at the heart of it all, Charles “Chuck” Blazer, had already pleaded guilty. The assault led to the final downfall of Joseph Sepp Blatter. FIFA forgot to ban or threaten America. Fuyaka! Monkey yansh dey smell. Next base jare!

Case number 4: Ghana’s FA President, Kofi Nyanthakyi when he was caught with oil on his dirty fingers for attempted corruption, he was not just fired but the entire FA Board was sacked by the host government, FIFA lost its stupid but useless voice. Suddenly, the special Nigerian desk inside FIFA headquarters manned by its usually corrupt staffers, which used to be manned by an Italian by name Primo Corvaro, can issue letters every hours. The beauty of those letters is that, they are usually written by a pseudo-Nigerian whose English is not the usual FIFA standard international language but a heavily Nigerian-accent.

The latest letter: As usual, there are many clairvoyant Nigerians who know when the FIFA letters will arrive and it usually arrives as predicted. The last one addressed to Giwa’s lawyer has all the trappings of the usual letters. Any moment from now, Festus Keyamo had predicted another FIFA letter is coming with five years ban! With the way and manner that the sitting FIFA Secretary General, Fatma Samoura got the job and how she was visited immediately after by Amaju Pinnick and Shehu Dikko, who when they were leaving gave her a massive gift, this is her own pay back time to do some friends a favour back.

With Primo Corvaro still inside the dinghy corridors of Gianni Infantino’s FIFA, it will not be difficult to ask the letters are done to save the new CAF Vice President, Amaju Pinnick so that the Nigerian Supreme Court orders would be spurned. The FIFA folks would have been advised ‘we know our nation well. Just do the letter. It will work the magic.” Moreso, the editors who are meant to do the damage had benefited greasy fingers, all were ferried to Russia to watch and report the World Cup. The media is secured.

The Crest is in possession of indisputable facts on the real reason why the Nigeria Football Federation, NFF, railroaded Ahmad Ahmad, President of the Confederation of African Football, CAF, to watch the Super Eagles engage the Simba of Congo DR in Monday’s international friendly. The match, last home engagement of the senior national team, preparatory to the 2018 FIFA World Cup in Russia, was played in Port Harcourt, the Rivers State capital. It yielded a 1-1 draw.

However, tongues started wagging even before the encounter as to why the NFF had to spend scarce resources to bring the CAF President to Port Harcourt willy-nilly. Checks by The Crest revealed that after the Supreme Court sacked the Pinnick Amaju led-NFF, its bigwigs had been working tirelessly to tighten their grip on the Federation and remain in office. And when all else had failed, the body resorted to dragging the CAF President to Nigeria as a last public relations stunt designed to impress club owners and NFF board members that the group was still in power.

The Crest can also exclusive report that Amaju, who seems not to fully understand the ramifications and implications of the April 27, 2018 landmark judgement by the Supreme Court, had made frantic efforts to appeal to the Minister of Sports, Solomon Dalung, and the Attorney General of the Federation, AGF, Abubakar Malami to intervene. But the fear of President Muhammadu Buhari marked the beginning of wisdom for the duo as they rebuffed the pressure on the grounds that the President, being a stickler for the rule of law and separation of powers, will never condone anyone breaching that sacred constitutional provision. Sources told The Crest in Port Harcourt that the chairman of the League Management Company, LMC, Mallam Shehu Dikko, last week, led a team of NFF stalwarts to Nasir El-Rufai, Kaduna State Governor, appealing to him to help them talk to the President to save their job. But they met a stone wall. The Governor reportedly told them, matter-of-factly, that he would never touch the idea with a long pole. Like the AGF, the governor also cited the rule of law.


Having failed both ways, Pinnick and his group flew the CAF boss to Port Harcourt to watch the Super Eagles/Simba match as a face-saving public relations resort. Football buffs have described that particular act as a show of desperation by a drowning man hanging to a raft. The question on lips of Nigerian football enthusiasts is: Has the CAF President not yet heard, or was he not sufficiently interested in Nigeria football to know that Pinnick is no longer NFF President, by virtue of the Supreme Court verdict? If he was in the know, why, then, did he choose to fraternise with illegality?

In any case, could Ahmad Ahmad’s presence in Nigeria have made any difference? How far could his presence in Port Harcourt go in legitimising the ongoing illegality? The answer to these is a definite ‘NO’. Rather than have any meaningful impact, it would yield a backlash for Ahmad who, hitherto, has enjoyed overwhelming support for ousting the old order in African football, and breathing new life into football administration in the continent. Lagos lawyer, Ralph Akintan, believes that Pinnick’s desperate struggle to convince President Buhari and Nigerians to jettison the Supreme Court judgement is like pouring water on the back of a duck. An exercise in futility. “Ahmad should be reminded that FIFA, under the leadership of Gianni Infantino respects the laws of member countries and Africa must key in quickly to save the continent from impending chaos,” Akintan told The Crest.


Meanwhile, as if to confirm The Crest investigation, Barrister Solomon Dalung, Minister of Youth and Sports, has embargoed any attempt by the NFF to organise any election this year. The Minister made the remark in Port Harcourt after the 1-1 draw by the Super Eagles against visiting Simba of DR Congo at the Adokiye Amesiemeka stadium. The Minister noted that the Federal Government has invested so much towards the Eagles’ qualification and achieving a respectable World Cup result than to allow any distraction at this crucial point when the focus of every participating nation is Russia.

Dalung stressed that a call for purchase of forms and setting up of a so-called electoral committee at this time was a distraction to the team’s preparation.
“The NFF should put everything concerning elections and electoral committees on hold,”Dalung said, “and concentrate on the World Cup preparation which is more important to the country.“The country has invested so much right from the campaign for a ticket till date, so, we cannot afford any distractions in the name of elections.”

Even if Pinnick steps down. FIFA will not recognize Giwa or anyone voted in with him. So his so called deputy can't take over. Giwa is currently suspended until 2021. Supreme court can't set aside that suspension. Only FIFA or CAS can set aside that suspension. I wonder if the supreme court judge will also rule the FIFA ban unconstitutional. Some Nigerians are blinded by greed and power. They throw reason out the door

I am shocked by your statement here. It does not matter whether you like Pinnick or not but this move ought to be condemned by any one who wants Nigeria's football to do well. If Pinnick is a failure then he should be removed via the proper channel which is the upcoming election. This move is simply ridiculous and will shut down Nigeria's football and for good reason.

Nigeria is full of self serving people that dont care about the impact of their actions.
They only want to get theirs and dont care if we all get hurt in the process. They dont study their history. They never hold themselves accountable or responsible.

Then they are the first to scream when things dont work, and redo the same thing over and over again.

Both the Federal High Court of Nigeria and the Supreme Court of Nigeria (should they decide that they have jurisdiction to enter any matter) have the ultimate legal power to set aside any decision that were made by FIFA and CAS Arbitrators. It must be noted that FIFA is not regarded as a Court of Law and CAS Arbitrators are normally practising lawyers.

The high court in Jos today heard arguments from both parties on the submission challenging the exparte order and the court's jurisdiction to hear the case abinitio and adjourned to Tuesday, July 10 for ruling.

Court directed that no one should take any actions on the order since it’s being challenged until the ruling is decided.

Implication: Status quo before the issuance of the order should be maintained.

Note: Status quo before the exparte order was the situation all the while Eagles were at the World Cup.

*Gradually, but steadily, this whole thing is grinding to a halt...The end is surely nigh...

Now lets see if Dalung, fearing Kuje prison, will now issue a statement to Giwa group to cease and desist in the name of the law following this current ruling. Let's see if Dalung indeed issues such a statement.

In any case and seriously, I hope that before Tuesday's ruling that the NFF makes it clear to the court that all parties involved in football have agreed as affiliated to FIFA that football conflicts are settled out of court and through established systems of arbitration. The court should then rule that the parties follow the established process if aggrieved. That should shut this down.

If Dalung is bent on shutting down Pinnick then he should do so via elections and not this rubbish tactics that is designed to crush the interest of all Nigerians because of the haunt of an individual.
